Everwhen EULA

This End User License Agreement (“Agreement”) governs your use of the Everwhen mobile application (“Everwhen”, “the App”, “we”, “us”, or “our”).

By downloading, installing, or using Everwhen, you agree to this Agreement. If you do not agree, do not use the App.

1. License

We grant you a limited, personal, non-exclusive, non-transferable, and revocable license to use Everwhen for personal, non-commercial purposes in accordance with this Agreement.

You may not copy, modify, distribute, sell, sublicense, reverse engineer, or attempt to extract the source code of the App except where such restrictions are prohibited by applicable law.

2. Purpose of the App

Everwhen provides tools for creating and tracking dates, events, timers, countdowns, time periods, reminders, and related information.

The App is provided as a convenience and organizational tool only.

You are responsible for verifying all dates, times, calculations, reminders, notifications, and other information displayed by the App.

3. User Content and Data

You are responsible for all information and content you enter into Everwhen.

Everwhen does not operate its own servers for storing your personal events, dates, timers, countdowns, notes, or similar user-created content.

Such information may be stored locally on your device and/or through system services available on your device.

You are responsible for maintaining appropriate backups of any information that is important to you.

We cannot guarantee that locally stored information can be recovered if it is deleted or lost.

4. Notifications and Reminders

Everwhen may provide notifications, reminders, countdowns, or other time-based features.

We do not guarantee that any notification or reminder will be delivered at a specific time or delivered at all.

Notification delivery may depend on your device, operating system, permissions, settings, battery conditions, system restrictions, or other factors outside our control.

You should not rely on Everwhen as the sole method of remembering critical deadlines, appointments, medication, legal obligations, financial obligations, travel arrangements, emergencies, or other important or time-sensitive events.

5. Subscriptions and Purchases

Everwhen may offer optional paid subscriptions, premium features, or other in-app purchases.

All purchases are processed through Apple’s App Store and are subject to Apple’s applicable payment and subscription terms.

Subscription prices and available plans are displayed before purchase.

Subscriptions may automatically renew unless canceled according to the terms displayed by Apple at the time of purchase.

You can manage or cancel your subscriptions through your Apple ID subscription settings.

6. Advertising and Third-Party Services

Everwhen may display advertisements and use third-party services for analytics, advertising, subscription management, crash reporting, and other technical functionality.

These services may include Google Firebase Analytics, Google AdMob, Apphud, and Apple services.

Third-party services are governed by their own terms and privacy policies.

7. Availability and Changes

We may modify, update, add, remove, suspend, or discontinue features of Everwhen at any time.

We do not guarantee that the App or any particular feature will always be available, error-free, or compatible with every device or operating system version.

8. Disclaimer of Warranties

Everwhen is provided on an “as is” and “as available” basis.

To the maximum extent permitted by applicable law, we make no warranties, express or implied, regarding the operation, accuracy, reliability, availability, or suitability of the App.

We do not guarantee that Everwhen will be uninterrupted, error-free, or free from data loss.

9. Limitation of Liability

To the maximum extent permitted by applicable law, we are not responsible for any direct or indirect loss, damage, missed event, missed deadline, lost data, lost opportunity, financial loss, or other consequence resulting from:

• your use of or inability to use Everwhen;
• incorrect information entered into the App;
• inaccurate dates, times, calculations, or countdowns;
• failure or delay of notifications or reminders;
• loss of locally stored information;
• device or operating system failures;
• third-party services;
• interruption or discontinuation of the App.

You use Everwhen at your own risk and remain responsible for verifying important information independently.

Nothing in this Agreement excludes or limits liability that cannot legally be excluded or limited under applicable law.

10. Acceptable Use

You agree not to misuse Everwhen, interfere with its operation, attempt unauthorized access, use the App for unlawful purposes, or violate applicable laws or regulations.

11. Intellectual Property

Everwhen, including its software, design, graphics, branding, interface, and other original content, is owned by us or our licensors and is protected by applicable intellectual property laws.

This Agreement does not transfer ownership of Everwhen or any associated intellectual property to you.

12. Termination

We may terminate or restrict your right to use Everwhen if you materially violate this Agreement.

You may terminate this Agreement at any time by stopping use of and deleting the App.

13. Changes to This Agreement

We may update this Agreement from time to time.

The updated version will become effective when published or otherwise made available to users, subject to applicable law.

14. Apple App Store

If you downloaded Everwhen through the Apple App Store, you acknowledge that this Agreement is between you and Everwhen’s developer, not Apple.

Apple is not responsible for the App or its content, maintenance, support, or warranties except as required under Apple’s applicable terms or applicable law.

Your use of Everwhen must also comply with the applicable Apple App Store terms and conditions.
